These Terms & Conditions ("Terms") govern the use of services provided by HimaDie Travels ("Company", "we", "our", or "us").
By booking a trip, using our website, communicating with our company, or using our services, the customer ("traveler", "client", "you") agrees to these Terms & Conditions.
These Terms are designed to protect both travelers and HimaDie Travels in accordance with international tourism industry practices and applicable legal requirements in Sri Lanka and for international travelers, including those from the European Union.
1. Bookings and Confirmations
- All bookings are subject to availability.
- A booking is considered confirmed only after receipt of the agreed payment or required deposit.
- HimaDie Travels reserves the right to refuse any booking at its reasonable discretion.
- Clients are responsible for providing accurate and complete information at the time of booking.
- Errors in information provided by the client may result in additional costs or travel disruptions.
2. Payments
- Prices are quoted in the currency specified in the quotation or invoice.
- A deposit may be required to confirm reservations.
- The remaining balance must be paid before the date specified by HimaDie Travels.
- In the event of delayed payment, HimaDie Travels may cancel reserved services.
- International bank charges, conversion fees, and transaction costs are the responsibility of the client unless otherwise stated.
- Payments made by card or through third-party platforms are subject to the conditions of the relevant payment providers.
3. Pricing and Rate Changes
- Prices may vary due to:
- currency fluctuations;
- increases in government taxes;
- fuel price increases;
- supplier modifications;
- circumstances beyond our control.
- HimaDie Travels reserves the right to adjust prices before final booking confirmation.
- After full confirmation and complete payment, no unreasonable increase will be applied unless legally required or caused by exceptional circumstances.
4. Cancellations by the Client
Any cancellation request must be made in writing via official email or WhatsApp.
Cancellation charges may include:
- Administrative fees
- Non-refundable hotel charges
- Transportation provider fees
- Prepaid activities
- Charges imposed by third parties
General cancellation guideline:
- More than 30 days before arrival: deposit may be non-refundable
- Between 15 and 30 days: up to 50% of the total amount
- Less than 15 days: up to 100% of the total amount
- No-show: no refund
Specific conditions may apply depending on hotels, seasons, or suppliers.
5. Cancellations or Changes by HimaDie Travels
HimaDie Travels reserves the right to modify or cancel certain services due to:
- weather conditions;
- security concerns;
- natural disasters;
- strikes;
- government decisions;
- operational problems;
- force majeure situations.
Where possible, reasonable alternatives will be offered.
HimaDie Travels shall not be held responsible for indirect losses, additional expenses, or damages resulting from circumstances beyond its reasonable control.
6. Traveler Responsibilities
The traveler is responsible for:
- Checking passport and visa validity
- Complying with local Sri Lankan laws and regulations
- Following safety instructions
- Arriving at agreed times
- Obtaining appropriate travel insurance
- Informing HimaDie Travels of important medical conditions
- Behaving respectfully toward staff, partners, and local communities
Any dangerous, illegal, abusive, or disrespectful behavior may result in immediate termination of services without refund.
7. Travel Insurance
HimaDie Travels strongly recommends that all travelers obtain comprehensive travel insurance covering:
- Trip cancellation
- Medical expenses
- Hospitalization
- Accidents
- Lost baggage
- Transportation delays
- Emergency evacuation
- Personal liability
HimaDie Travels is not responsible for losses that could have been covered by appropriate insurance.
8. Passports, Visas, and Documentation
- Travelers are fully responsible for their travel documents.
- HimaDie Travels may provide informational assistance regarding visas but does not guarantee visa approval.
- Any visa refusal or administrative issue remains the responsibility of the traveler.
- Clients must verify health and entry requirements before departure.
9. Health and Medical Conditions
- Travelers must inform HimaDie Travels of any relevant medical conditions before travel.
- Certain activities may not be suitable for some physical or medical conditions.
- HimaDie Travels shall not be responsible for issues resulting from undisclosed medical information.
- In case of medical emergency, we may contact medical services or the emergency contacts provided.
10. Accommodations and Third-Party Services
- Hotels, transport companies, guides, and activity providers are independent suppliers.
- HimaDie Travels acts as an intermediary in organizing services.
- We cannot guarantee the permanent availability of certain facilities or services.
- Hotel photos, descriptions, and categories are provided for guidance purposes only.
- Local standards may differ from European standards.
11. Excursions, Safaris, and Activities
Certain activities involve inherent risks, including:
- Safaris
- Water sports
- Hiking
- Adventure activities
- Wildlife observation
By participating in such activities, travelers acknowledge and accept certain reasonable risks.
Participants must follow the instructions of guides and local operators.
12. Force Majeure
HimaDie Travels shall not be held responsible for delays, modifications, interruptions, or cancellations caused by events beyond its reasonable control, including:
- Natural disasters
- Pandemics
- Epidemics
- Extreme weather conditions
- Strikes
- Civil unrest
- Terrorism
- Transport failures
- Government restrictions
- Border closures
In such situations, refunds will depend on the policies of the relevant suppliers.
13. Limitation of Liability
To the maximum extent permitted by law:
- HimaDie Travels shall not be liable for indirect or consequential losses.
- Our total liability shall not exceed the amount actually paid for the relevant services.
- We are not responsible for losses resulting from actions of independent third parties.
- We do not guarantee the complete absence of interruptions, delays, or unforeseen events during travel.
Nothing in these Terms limits mandatory rights provided by applicable consumer protection laws.
14. Complaints
- Any complaint should be reported as soon as possible during the trip to allow prompt resolution.
- Written complaints should be submitted within a reasonable period after the end of the trip.
- Relevant evidence (photos, documents, receipts) may be requested.
HimaDie Travels will review complaints in good faith and within reasonable timeframes.
15. Website Use
By using our website, users agree:
- Not to use the website for illegal purposes
- Not to attempt unauthorized access to our systems
- Not to distribute harmful or malicious content
- To provide accurate information
HimaDie Travels may suspend website access in cases of misuse.
16. Intellectual Property
- Website content, logos, texts, photos, and marketing materials remain the property of HimaDie Travels or their respective owners.
- Unauthorized reproduction is prohibited.
- Clients may use provided materials only for personal and non-commercial purposes.
17. Personal Data Protection
The use of personal data is governed by our Privacy Policy.
By using our services, clients acknowledge that they have reviewed this policy.
18. Electronic Communications
Clients agree that certain communications may be conducted electronically through:
- Telephone
- Social media
Clients are responsible for regularly checking their messages and communications.
19. Photos and Media Content
Unless the client objects in writing:
- HimaDie Travels may use certain photos or videos taken during trips for promotional purposes.
- No misleading or abusive use will be made.
- Clients may request removal of content concerning them.
20. Language and Interpretation
These Terms may be available in multiple languages.
In the event of interpretation differences, the English version may prevail for legal matters.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of Sri Lanka.
Any dispute shall be subject to the competent jurisdiction of Sri Lankan courts unless mandatory consumer protection laws provide otherwise.
22. Amendments to the Terms & Conditions
HimaDie Travels reserves the right to modify these Terms at any time.
The latest version will always be published on our official website.
Continued use of our services after publication of changes constitutes acceptance of the revised Terms.
